How we protect personal data: the organization takes the protection of your data seriously and takes appropriate measures to prevent misuse, loss, unauthorized access, unwanted disclosure, and unauthorized modification.

Personal data that we process: The organization processes your personal data because of your visit to our website, because you have been in contact with us, because you have entered a client relationship with us or because you use our services in a different way and/or because you have (provided) them to us yourself.

  • Other personal data that you actively provide, via our website, in correspondence and by telephone

Special and/or sensitive personal data that we process.

The organization processes (or may) process the following special and/or sensitive personal data about you:

  • Criminal history, facts, or convictions
  • Data of persons under 16 years of age
  • Personal data showing race or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, and processing of genetic data, biometric data for the purpose of uniquely identifying a person, or data on health, or data relating to a person’s sexual behavior or sexual orientation.

Our website and/or service does not intend to collect data about website visitors under the age of 16. Unless they have permission from parents or guardians, or we are bound by the performance of our legal obligations. 

However, we cannot check if a visitor is over 16. We therefore advise parents to be involved in their children’s online activities, in order to prevent data about children from being collected without parental consent.

For what purpose and on what basis we process personal data: the organization processes your personal data for the following purposes: 

  • To comply with the legal obligations incumbent on the organization;
  • To represent the vital interests of you or of another natural person;
  • For the performance of a task in the public interest or of a task in the exercise of public authority (or may) be entrusted to the organization;
  • To represent the legitimate interests of the organization or of third parties. 
  • Processing for archiving purposes in the public interest, scientific or historical research or statistical purposes;
  • Handling your (possible) payments;
  • Sending our newsletters and (possible) advertisements;
  • To be able to call or e-mail you if this is necessary to be able to perform our services;
  • Inform you about changes to our services and products;
  • To offer you the opportunity to make an appointment;
  • To offer you the possibility to send a message;
  • To (potentially) offer you the possibility to create an account; 
  • To deliver goods and services to you;
  • The organization also processes personal data if we are legally obliged to do so, such as data that we need for our tax return;

Automated decision-making*: the organization does not make decisions based on automated processing on matters that can have (significant) consequences for people.

*These are decisions that are made by computer programs or systems, without involving a person (for example, an employee).

How long we keep personal data: the organization does not store your personal data for longer than is strictly necessary to achieve the purposes for which your data is collected. 

We use the following retention periods for the personal data:

10 years (unless a longer term is required by a legal obligation)

Sharing personal data with third parties: the organization does not sell your data to third parties and only provides it if this is necessary for the execution of our legal obligations and powers or the agreement with you.

The organization remains responsible for these processing operations.

The cookies we use are necessary for the technical functioning of the website and your ease of use. They ensure that the website works properly and remember, for example, your preferred settings. In addition, you can also delete all information previously stored via your browser’s settings. 

Viewing, modifying, or deleting data: You have the right in principle to view, correct or delete your personal data. In addition, you have the right to withdraw your consent to the data processing or to object to the processing of your personal data by the organization and you have the right to data portability. This means that you can submit a request to us to send the personal data that we hold about you in a computer file to you or another organization mentioned by you.

You can send a request for access, correction, deletion, data transfer of your personal data or request for withdrawal of your consent or objection to the processing of your personal data to info(at)advocaatballegeer.be.

To ensure that the request for access has been made by you, we ask you to send a copy of your identity document with the request. In this copy, black out your passport photo, MRZ (machine readable zone, the strip with numbers at the bottom of the passport), passport number and Citizen Service Number (BSN (in Dutch) – CSN). This is to protect your privacy.

The organization insists on responding as soon as possible, but within 30 days, at your request.

However, you must keep in mind that the organization may not be obliged to comply with your request for inspection, correction, deletion, or transfer. This is because of our legal obligations, reasons in the public interest (preservation, statistical analysis, scientific or historical research), for the organization, exercise or substantiation of a legal claim or the justified exercise of the right to freedom of expression and/or information.
